This Terms of Service and Privacy Policy Agreement (“Agreement”) governs your access to and use of the website located at https://odysseymechanical.com (“Website”), owned and operated by Odyssey Mechanical, LLC (“Company,” “we,” “us,” or “our”), and governs our practices with respect to personal information collected through the Website and communications initiated by the Company.

By accessing or using this Website or submitting personal information through any form or communication channel provided herein, you acknowledge that you have read, understood, and agree to be legally bound by the terms of this Agreement, including all applicable statutes and regulations, including the Telephone Consumer Protection Act (TCPA), Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM), California Online Privacy Protection Act (CalOPPA), Children’s Online Privacy Protection Act (COPPA), and the CTIA Messaging Principles and Best Practices.

If you do not agree to the terms herein, do not access or use the Website or provide us with any information.

1. Scope and Permitted Use

This Website is intended solely for individuals located within the United States who are at least eighteen (18) years of age. The Website may be used only for lawful purposes related to exploring services offered by the Company and requesting appointments or information. Any unauthorized use, including but not limited to fraudulent submissions, scraping, or unlawful conduct, is strictly prohibited.

We collect personally identifiable information (“PII”) through voluntary submissions via forms, email, SMS, live chat, and phone interactions. This may include:

7. Communications and Marketing Disclosures

By submitting your contact information through the Website, you expressly authorize the Company to contact you via telephone (manual or automated), email, and SMS/MMS messaging for both transactional and marketing purposes, in accordance with the TCPA, CAN-SPAM, and applicable federal and state law.

Message Frequency:  Message frequency may vary based on your service status, project involvement, and marketing participation. You may receive recurring messages during active service periods.

Message & Data Rates:  Standard carrier rates may apply.

Opt-Out:  You may revoke consent to SMS by replying with “STOP”, “UNSUBSCRIBE”, “END”, “CANCEL”, “QUIT”, or “STOPALL”. You may unsubscribe from emails via the “Unsubscribe” link provided in each message or by contacting us at service@odysseymechanical.com.

Consent to receive communications is not a condition of purchase.

8. SMS/MMS Program Terms (10DLC Compliance)

Program Description:  By opting into SMS services, you consent to receive mobile text messages from Odyssey Mechanical regarding quotes, project updates, scheduling, service reminders, promotions, and account-related correspondence.

Message Frequency:  Expected frequency is 5–10 messages per month, depending on customer engagement and service interactions.

Opt-Out Protocol:  To discontinue receiving messages, text STOP or one of the authorized keywords listed above. A confirmation message will be sent. You may opt back in at any time by submitting your information again or texting START.

Support/Help:  Reply with HELP for assistance, or contact us at service@odysseymechanical.com or 910-392-6400.

Carriers Not Liable:  Mobile carriers are not responsible for delayed or undelivered messages.

Data Use and Disclosure:  All SMS interactions are governed by our general privacy terms. We do not share phone numbers with third parties for marketing purposes.

9. CalOPPA Compliance

We adhere to the California Online Privacy Protection Act, including:

  • Allowing users to visit the Website anonymously
  • Publishing this policy prominently via link on the homepage
  • Providing users access to modify or correct their data
  • Notifying users of any material changes to this policy

10. COPPA Compliance

We do not knowingly collect, use, or disclose information from individuals under the age of 13. If you believe a child has submitted personal data to us, please contact us so it may be deleted.

11. Fair Information Practices & Breach Notification

In the event of a data breach, affected users will be notified via the Website within twenty (20) business days. We support the Individual Redress Principle, granting users the right to pursue legal remedies in the event of non-compliance.

12. CAN-SPAM Act Compliance

We commit to:

  • Using truthful subject lines and sender identities
  • Providing clear identification of promotional content

  • Processing opt-out/unsubscribe requests within ten (10) business days

13. Limitation of Liability

14. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the State of North Carolina, without regard to its conflicts of law principles. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of courts located in New Hanover County, North Carolina.

15. Modifications

We reserve the right to amend this Agreement at any time without notice. Updates will be posted on this page. Continued use of the Website following changes constitutes your acceptance of those changes.
